Please read the following terms and conditions carefully before signing below. They explain how the Agent, in assessing your suitability for tenancy may use the information you have supplied and is governed by the General Data Protection Regulation. Before your application can be fully considered, you will need to pay a Holding Deposit equivalent to one weeks’ rent. The following terms and conditions explain the circumstances under which your Holding Deposit may be refunded, withheld, or set against your first month’s rent.

This is a legally binding agreement. It is important that you know your legal rights, so if you are unsure of your obligations under this agreement, you are advised to take independent legal advice before signing.


I understand that the information I have provided on my Tenancy Application Details form may be submitted to one or more credit reference agencies for the purpose of obtaining a credit reference to establish my credit worthiness. I understand that the result of that credit reference shall not form the only basis for the acceptance or rejection of my application for tenancy.

I understand that in the event of any default by me in respect of the covenants in my tenancy agreement, the information I have provided on my Tenancy Application Details form may be shared with third parties in order to recover any monies due, or to trace my whereabouts. I understand and give my consent for you to share my personal details with third parties for the purpose of fraud prevention, credit risk reduction, or providing future references (we will only share your personal information for these purposes and we will ensure that it is secure and protected from any unauthorised access).

I understand that the information I have provided on my Tenancy Application Form is information as described in Ground 17 of the Housing Act 1996 and that if any of this information is found to be untrue, it is grounds for termination of the tenancy.


I understand that once I have paid my Holding Deposit, current legislation stipulates that all necessary tenancy application paperwork should be completed within 15 days (the Application Period), unless an extended Application Period has been specifically agreed in writing with The Right Place. This includes the provision of written references from my employer, former landlord, character referee, etc.

I understand that, if at any time after paying my Holding Deposit I decide not to proceed with the tenancy, or if I decline an offer of tenancy, then my Holding Deposit will be withheld. Equally, if I delay providing any relevant information or documents requested by you, which delays completion of my tenancy application beyond the Application Period, or if I provide false or misleading information as part of my tenancy application, or if I fail any of the checks that the Landlord or Agent are required to undertake under the Immigration Act 2014, then my Holding Deposit will be withheld.

I understand and agree that, if my tenancy application is successful, my Holding Deposit will be credited against my first month’s rent.

I understand that my Holding Deposit will be refunded within 7 days if my application is successful, but you are unable to offer me a tenancy for any reason unconnected with the above.

I understand that, if my Holding Deposit is withheld, or otherwise not credited against any rental liability, I will be provided with a written explanation within 7 days of its forfeiture.

I understand that I will not be asked to pay any fees or charges in connection with my application for tenancy. However, if my application is successful, I understand that I will be required to pay certain fees for any breach of my tenancy agreement in line with the Tenant Fees Act 2019. In consideration of you processing my tenancy application, I agree to pay those fees to you upon request.


I understand that you allow a maximum of 15 days (the Application Period) to complete my tenancy application and obtain responses to my references. Upon receipt of an offer of tenancy I must be prepared to start my tenancy within 15 days of the date of paying my Holding Deposit. Later tenancy start dates may be agreed at the Landlord’s discretion. If I do not complete my application within the Application Period, or accept the tenancy start date in accordance with these conditions, then my Holding Deposit will be withheld.


The tenancy application will only be successful if all the Applicants named on the Tenancy Application Form(s) receive suitable references (applies to Joint Applications). Any Applicant who does not meet the required criteria will be rejected.

Guarantors must be in permanent employment, creditworthy (i.e. free of any adverse credit history) and earning at least three times the annual rent. Evidence of their status will be required.
